bolehkah orang tua mengambil harta anak tanpa izin? imam abu daud yang mempunyai nama lengkap abu daud sulaiman bin al – asy’ats as – sajistani (202 – 275 h) , mengantarkan judul bab dalam kitab sunannya (sunan abu daud) ,
“seseorang memakan harta anaknya. ”
dari ‘aisyah radhiyallahu ‘anha, nabi shallallahu ‘alaihi wa sallam bersabda,
إِنَّ مِنْ أَطْيَبِ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَوَلَدُهُ مِنْ كَسْبِهِ
“sesungguhnya sebaik – baik yang dimakan oleh seorang merupakan dari hasil usahanya. anak itu merupakan hasil usaha orang tua. ” (hr. abu daud, nomor. 3528; an – nasai dalam al – kubra, 4: 4. al – hafizh abu thahir berkata kalau hadits ini shahih)
dalam riwayat lain disebutkan,
وَلَدُ الرَّجُلِ مِنْ كَسْبِهِ مِنْ أَطْيَبِ كَسْبِهِ فَكُلُوا مِنْ أَمْوَالِهِمْ
“anak seorang itu merupakan hasil dari usahanya, itu merupakan sebaik – baik usahanya. hingga makanlah dari harta mereka. ” (hr. abu daud, nomor. 3529. al – hafizh abu thahir berkata kalau hadits ini shahih)
dari ‘amr bin syu’aib, dari ayahnya, dari kakeknya, dia mengatakan kalau terdapat seorang menghadiri nabi shallallahu ‘alaihi wa sallam, kemudian dia mengatakan,
“wahai rasulullah, sebetulnya saya mempunyai harta dan juga anak. tetapi orang tuaku memerlukan hartaku. rasulullah setelah itu menanggapi,
أَنْتَ وَمَالُكَ لِوَالِدِكَ إِنَّ أَوْلاَدَكُمْ مِنْ أَطْيَبِ كَسْبِكُمْ فَكُلُوا مِنْ كَسْبِ أَوْلاَدِكُمْ
“engkau dan juga hartamu kepunyaan orang tuamu. sebetulnya anak – anakmu merupakan sebaik – baik hasil usahamu. makanlah dari hasil usaha anak – anakmu. ” (hr. abu daud, nomor. 3530; ahmad, 2: 214. al – hafizh abu thahir berkata kalau sanad hadits ini hasan. syaikh syu’aib al – arnauth melaporkan kalau hadits ini shahih lighairihi, sanad haditsnya hasan)
ibnu qudamah al – maqdisi melaporkan dalam al – mughni (8: 272) , boleh aja seseorang bapak mengambil harta anaknya semaunya kemudian dia miliki, terlebih hingga itu diperlukan oleh bapaknya.
begitu pula masih dibolehkan walaupun perihal itu bukan hajat berartinya. bapak tersebut boleh mengambil harta tersebut dari anaknya yang masih kecil ataupun berusia.
tetapi pembolehan bapak mengambil harta anaknya asalkan penuhi 2 ketentuan:
tidak memusnahkan harta dan juga tidak memudaratkan anak, pula bukan mengambil yang jadi kebutuhan berarti anaknya.
tidak boleh mengambil harta tersebut dengan tujuan buat membagikan pada yang lain.
